Deadline Extended for Owners of Condominium Units to File an Appeal to Inclusion in the Homer Natural Gas Special Assessment District.

WASHINGTON, D.C. – April 20, 2015 – (RealEstateRama) — The City of Homer has petitioned to the Alaska Supreme Court for review of the April 3, 2015 decision of the Superior Court invalidating assessments of condominium units in the Homer Natural Gas Distribution Special Assessment District in the case of Castner v. City of Homer. The City and Mr. Castner have agreed to terms of a stay of the Superior Court’s decision pending disposition of the City’s petition for review.

Those terms provide that the time for the owner of any condominium unit subject to special assessment in the Homer Natural Gas Distribution Special Assessment District to file an administrative appeal in the Superior Court from the assessments confirmed by City of Homer Resolution 15-017 shall be considered suspended and extended. Should any condominium unit owner wish to file such an appeal, that appeal may be filed in the Superior Court within 30 days after the date of the disposition of the Petition for review. The time for appeals from assessments by owners of properties that are not condominium units has not changed.
